Social Security Fairness Act Repeals WEP and GPO

What happened?

On January 5, 2025, the Social Security Fairness Act (HR 82) was enacted. This law repeals the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO), which reduce Social Security benefits for some who receive pensions from non-Social Security systems and don’t participate in Social Security. The Act prevents reductions in Social Security benefits due to pensions earned for work not covered by Social Security.

Does this impact your MERS benefits?

There is no impact to your MERS benefits. Any payment adjustments necessary will only be applied to your Social Security benefits.
